Counsel to Management: Conduct a full compliance audit on your operation including, but not limited to wages, hours, and working conditions, meals and breaks and over time, safety, field sanitation, heat illness prevention, and also, establish a protocol for third-party provider of services such as farm labor contractors, and other growers that you may be doing business with and to ensure compliance with the child labor provisions of the Fair Labor Standards Act under “Hot Goods.” Having good contracts, establishing you as a good-faith purchaser of such goods, is critical with the U.S. Department of Labor now helping organized labor in organizing workers by bringing swift and certain retaliation against employers caught up in these types of relationships that may not be compliant.
